Terms & Conditions - the basics

These Terms and Conditions outline the agreement between you (the Client) and Oz Building & Pest Inspections (ABN: 38 636 056 945), a professional inspection business operating in Victoria, for the provision of building and pest inspection services.
A. DEFINED TERMS

Building Consultant means Oz Building & Pest Inspections (ABN: 38 636 056 945).

Client means the person or party engaging the Consultant to provide inspection services.

Property means the subject property to be inspected.
-
Report means the final written inspection report provided to the Client.
-
Major Defect is a significant fault requiring urgent repair to avoid safety risks, further deterioration or loss of function.
-
Minor Defect means superficial, non-critical issues often related to maintenance.
-
Readily Accessible Areas means safe areas easily accessible for inspection without damage or forced entry, with required access dimensions.
-
Building & Site includes the dwelling and any relevant external structures within 30m of the property boundary.
B. SCOPE OF INSPECTION

Inspections are visual assessments conducted in accordance with AS 4349.1-2007 (Pre-Purchase Inspections – Residential Buildings) and/or AS 4349.2, depending on the service.

The report includes:

Urgent and serious safety hazards
-
Major structural or maintenance-related defects
-
General condition of the property
-
The report does not constitute a certificate of compliance or guarantee against future defects.
C. ACCEPTANCE OF TERMS

By booking an inspection, the Client:

Acknowledges acceptance of these Terms & Conditions

Agrees that these terms form a binding agreement upon booking or upon the consultant attending the property

Accepts liability for all inspection fees as per the invoice terms
D. LIMITATIONS OF INSPECTION

The Client acknowledges:
-
The inspection is non-invasive and visual only
-
The report may exclude concealed, inaccessible, or obstructed areas
-
Furniture, stored items, finishes, and environmental factors may obscure defects
-
The inspection does not address compliance with building codes or regulations
E. ACCESSIBILITY

The Client is responsible for:
-
Ensuring access to all relevant areas of the property
-
Coordinating with tenants, agents, or owners as necessary
-
Disclosing known limitations or hazards
-
Areas excluded from inspection due to inaccessibility will be noted in the report.
F. LIMITATION OF LIABILITY

To the maximum extent permitted by law:
-
Liability is limited to the resupply of the service or refund of the inspection fee

Oz Building & Pest Inspections is not liable for indirect or consequential losses
-
All claims must be submitted within 30 days of report delivery
-
Legal liability ceases 6 months from the inspection date
-
Third-party reliance on the report is not permitted
G. EXCLUSIONS -
The inspection does not include, unless otherwise agreed:

Plumbing, electrical, and gas systems
-
Pools, spas, and associated equipment
-
Fireplaces, flues, appliances, air conditioning
-
Smoke detectors, alarms, intercoms, CCTV
-
Environmental hazards (e.g., asbestos, mould, lead)
-
Footings, drainage adequacy, or structural engineering
-
Common property (unless specifically requested)
-
Pest detection unless part of a combined pest inspection
H. CLIENT OBLIGATIONS
The Client agrees to:

Rely only on the final written report
-
Not act on verbal or preliminary advice without confirmation in the report

Engage appropriate professionals for matters outside the inspection scope

Take appropriate action based on recommendations in the report
I. COMPLAINTS PROCESS
If dissatisfied:
-
The Client must notify the Consultant in writing within 30 days of report issuance
-
The Consultant must be given the opportunity to inspect and respond within 30 days of notice
J. GOVERNING LAW
These Terms are governed by the laws of Victoria, Australia.
All legal matters will be subject to the exclusive jurisdiction of the courts of Victoria.
K. ENTIRE AGREEMENT
These Terms and Conditions constitute the entire agreement between the Client and Oz Building & Pest Inspections.
No oral representation or prior document will override these written terms.
